How Bodhi & Digby resurrected a product banned from Amazon for a product safety breach

Our partner in this case was a company that had just acquired several well-known cosmetic brands in the United States.


Problem

The products were doing well on Amazon North America and some resellers saw an opportunity to expand their offerings to Amazon Europe. The problem is that the European Union has very specific Cosmetic Product Safety Regulations (CPSR) and products compliant with United States regulations are not automatically compliant with EU laws. The brand’s non-compliant products were offered for sale on Amazon EU.


Impact

UK Trading Standards (the government department responsible for consumer safety) investigated these Amazon sales, concluded that the products were non-compliant and issued Amazon with something called a “takedown request”. Amazon immediately banned all the brand’s products from its European platforms causing both financial and reputational damage to the parent company.


Need

The brand needed to ensure that its products were fully compliant with EU laws governing cosmetic product safety, get the Amazon ban overturned and drive sales on Amazon Europe.


What did Bodhi & Digby do to meet these needs?

We used our extensive expertise with EU Product Safety regulations to assess the US market versions of these cosmetic products and produce a compliance plan. We arranged for an independent laboratory to test and accredit the products for safe and compliant sale in Europe, created the legally-mandated Product Information Files and registered everything on the EU Portal.

We then re-designed the product labels to meet EU regulations. Working closely with UK Trading Standards and Amazon we confirmed compliance and had the products reinstated on the Amazon platform.
